Uncontested and Amicable Divorce

The process of divorce does not need to be a drawn-out dispute between the divorcing partners. If a couple has reached an agreement on the terms of the divorce, or wishes to resolve their case amicably, they can avoid court and enter into an uncontested settlement. This is considered an amicable divorce or an uncontested divorce.

We recognize that sometimes the best way to get through your divorce is to allow the process to move quickly. At Stern Mendez, our experienced and compassionate attorneys will help you work toward a swift resolution when it’s in your best interest.

While two terms are often used interchangeably, it is possible that an uncontested divorce will not be amicable, and likewise that an amicable divorce will not be uncontested.

What is an amicable divorce?

An amicable divorce typically refers to a divorce where the parties remain on good terms and are satisfied with the resolution of the case (such that they do not need to go to court). The parties do not need to be in full agreement; but as long as they are willing to discuss any contested issues, the case may be resolved amicably.

What is an uncontested divorce?

An uncontested divorce is a divorce where all issues are resolved, although the parties need not get along.

Benefits of Uncontested or Amicable Divorce in the Chicago Area

Amicable and uncontested divorce cases proceed quickly and typically costs less than litigated divorce. This, combined with a lack of spousal fighting and discovery requests, greatly reduces the emotional and financial burden of the divorce process. Our attorneys will do what we can to keep your Illinois divorce case amicable and to prevent further damage to family relationships.

To begin discussing a settlement and identify the issues that may be settled quickly, you and your family law attorney should meet early in the case. Many problems can be resolved with a phone call, and your divorce lawyer should take measures to ensure that the lines of communication stay open.
